§ 13-32. Appeal of decisions of local Fire Official and local Building Official.

  • (a)

    In accordance with F.S. § 553.73(11), the Board of County Commissioners is hereby designated as the local administrative agency responsible for hearing and resolving appeals of decisions of the local Fire Official and local Building Official concerning application and interpretation of the Florida Fire Prevention Code, Florida Building Code and the Life Safety Code (the "codes").

    (b)

    In rendering a decision on any such appeal, the Board of County Commissioners shall consider and apply those criteria, eligibility and conditions set forth in Section 13-7 in making its determination of whether the application of the codes is reasonable under the circumstances.

    (c)

    The Board may specify alternatives to a decision of the local Fire Official or local Building Official, taking into consideration all relevant circumstances, which alternatives in the judgment of the Board provide an equivalent degree of life safety protection and equivalent method of construction to that which is provided in the codes.
